2. Data Processing in Connection with Your Online Application

The processing of personal data in connection with your online application serves the purpose of managing and conducting the recruitment process.

During the application process, we require certain personal data and information. In particular, the following categories of personal data may be processed via the application form:
  • Personal data, e.g. first and last name, address, date of birth, email address and telephone number
  • Information relating to the position and your professional background
  • The corresponding application documents
  • Any other information you provide to us in connection with your application

Following completion of the recruitment process for the respective position, Degussa Goldhandel GmbH will retain your application data only to the extent necessary to safeguard our legitimate interests.

The retention period in the applicant management system is limited to **six months following completion of the recruitment process**.

3. Retention of Your Application Data for Future Vacancies

If your application may also be suitable for other positions within Degussa Goldhandel GmbH, your data will only be used beyond the specific recruitment process if you have expressly consented to such use.

Degussa Goldhandel GmbH will obtain your consent in advance. Your consent is entirely voluntary. If you do not consent, this will not result in any disadvantage with regard to your current application.

4. Use and Protection of Your Application Data

Degussa Goldhandel GmbH has implemented technical and organisational measures to protect your application data against accidental or intentional manipulation and unauthorised access. Your data is transmitted in encrypted form using currently recognised state-of-the-art technology.

During the recruitment process, access to your application data is restricted to those persons involved in the recruitment process. This includes the Human Resources department, the manager responsible for the vacancy and, in exceptional cases, other persons relevant to the hiring decision.

The responsible manager and, where applicable, other interview participants are granted temporary access to the application documents solely for the purpose of reviewing and evaluating your application.

Your application data will not otherwise be disclosed to third parties unless we are legally obliged to do so or you have expressly consented to such disclosure.

Outside individual recruitment processes, Degussa Goldhandel GmbH will use application data solely for anonymised statistical purposes. No other use will be made of your data.

5. Retention Period and Deletion of Your Application Data

Degussa Goldhandel GmbH retains your application data for a period of six months after completion of the recruitment process.

After expiry of this period, your application data will be deleted, subject to statutory retention requirements, unless:

  • you have consented to the continued processing of your application data for future vacancies in accordance with Section 3; or
  • continued retention is necessary for the establishment, exercise or defence of legal claims in accordance with Section 6.

In these cases, Degussa Goldhandel GmbH will delete the data without undue delay once the respective reason for continued retention no longer applies.

The legal basis for processing your application data depends on the purpose for which the data is processed.

Data Processing in Connection with Your Online Application

The legal basis for processing your application data for the purpose described above is Art. 6 (1) (b) in conjunction with Art. 88 GDPR and Section 26 BDSG.

Without processing this data, we are unable to process your online application or conduct the online recruitment process.

Data Processing for Future Vacancies

The legal basis for processing your application data for the purpose described above is Art. 6 (1) (a) GDPR.

We will only continue to process your data in our applicant management system beyond the specific recruitment process if you have expressly consented to such processing.

Data Processing for the Defence of Legal Claims

The legal basis for processing your data for this purpose is Art. 6 (1) (f) GDPR.

In individual cases, we may process your data to safeguard a legitimate interest. Such an interest may exist, for example, for the defence against potential legal claims, including claims arising in connection with the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz – AGG).

In the event of a potential legal dispute, we also have a legitimate interest in retaining the relevant data for evidentiary purposes.

Right to rectification: You have the right to request the rectification without undue delay of inaccurate personal data concerning you (Art. 16 GDPR).

Right to erasure: You have the right to request the deletion of personal data concerning you. This applies, for example, where we no longer require the personal data for the purposes for which it was collected or otherwise processed, where the data has been processed unlawfully, where you have validly objected to the processing, or where there is a legal obligation to delete the data (Art. 17 GDPR).

Right to restriction of processing: You have the right to request restriction of the processing of your data. This applies in particular while the accuracy of data disputed by you is being verified, where you are entitled to deletion but request restriction of processing instead, where we no longer require the data for our purposes but you require it for the establishment, exercise or defence of legal claims, or while it is being determined whether an objection raised by you should prevail over our legitimate grounds for processing (Art. 18 GDPR).
